Synopsis
1. Scope and Agreement
This Website Privacy, Communications, and Messaging Policy ("Policy") explains how Liliths High Tide ("Liliths," "we," "us," or "our") collects, uses, discloses, retains, and protects information associated with visits to the Liliths High Tide website at LilithsHighTide.com, contact form inquiries, the Join Liliths High Tide Communications List, and related communications. It also states the terms that apply when a person separately enrolls in email, telephone, automated or prerecorded call, or SMS/MMS communications.
The website and communications list are intended primarily for people in the United States. The website may be accessible from other locations, but Liliths does not target its communications program outside the United States. If applicable law gives a person additional rights or imposes stricter requirements, applicable law controls.
Using the website or submitting information acknowledges this Policy but does not, by itself, constitute consent to receive marketing communications. Enrollment in a particular marketing channel occurs only through the consent or permission required for that channel. Providing a cell-phone number does not, by itself, enroll a person in marketing SMS/MMS messages or automated or prerecorded marketing calls.
Participation in the communications list is voluntary and is not a condition of purchasing goods or services.
2. Information We Collect
Liliths may collect the following information in connection with the website, contact inquiries, and communications program:
- Name, email address, cell-phone number, topic selection, message, and other information voluntarily submitted through the contact form.
- Name, email address, cell-phone number, and other information submitted through a communications signup form.
- Subscription status and preferences for each communications channel.
- Consent records, including the signup source, date, time, selected channel, and disclosure presented when consent was given, when available.
- Delivery, engagement, and interaction information, such as whether an email or message was delivered, opened, clicked, bounced, or answered.
- Opt-out, unsubscribe, suppression, and do-not-contact records.
- Information voluntarily provided in replies, calls, text conversations, or other communications with Liliths.
- Website usage and technical information, which may include IP address, approximate location derived from an IP address, browser type, device type, operating system, referring page, pages viewed, links selected, dates and times of visits, session activity, cookies, and similar identifiers.
- Security and anti-abuse information processed in connection with protecting the website and contact form from spam, fraud, and automated submissions.
Liliths does not ask people through the public contact or communications forms for payment-card information, Social Security numbers, passwords, or other sensitive credentials.
3. How We Collect Information
Liliths collects information directly when a person visits the website, submits a contact or signup form, updates communication preferences, communicates with us, or opts in or out of a channel.
Liliths and its service providers may also collect limited website usage and technical information automatically through server logs, cookies, pixels, scripts, local storage, security tools, analytics tools, and similar technologies. The particular technologies used may depend on which website and communications features are enabled.
Mailchimp and other communications providers may collect information on Liliths' behalf when they host or support forms, maintain subscriber records, deliver communications, process replies, measure engagement, or provide connected-site features.
4. How We Use Information
Liliths may use information collected through the website, contact inquiries, and communications program to:
- Operate, maintain, troubleshoot, and improve the website.
- Respond promptly to contact form inquiries by email, telephone call, or inquiry-related text message.
- Understand website traffic, page usage, visitor interactions, and the effectiveness of website content.
- Administer the list and maintain subscriber preferences.
- Send occasional news, promotions, product announcements, event invitations, surveys, and personalized offers.
- Place telephone calls or send SMS/MMS messages when the subscriber has provided the permission required for that channel.
- Confirm subscriptions, respond to questions, provide support, and process opt-out requests.
- Personalize content and understand engagement with our communications.
- Prevent fraud, misuse, spam, and security incidents.
- Comply with legal obligations, carrier requirements, Mailchimp requirements, and enforceable requests.
- Maintain records needed to demonstrate consent, honor preferences, and avoid contacting people who have opted out.
When a person submits an inquiry through the contact form, Liliths High Tide may use the telephone number provided to call or text that person regarding the inquiry. These direct responses are separate from the optional SMS marketing program. Providing a telephone number through the contact form does not enroll the person in marketing SMS or MMS messages. Anyone who would also like to receive Liliths High Tide promotions and updates by text can join the SMS marketing list by checking the separate SMS consent box on the contact form.
5. Email Communications Policy
Subscribers who enroll in email communications may receive occasional Liliths news, promotions, product announcements, event invitations, surveys, personalized offers, and related updates. The frequency is occasional and may vary.
Marketing emails will identify Liliths as the sender, use accurate routing and subject information, include our valid postal address, and provide a Mailchimp unsubscribe mechanism. A subscriber may unsubscribe through the link in any marketing email. Liliths will process email opt-out requests as required by applicable law and will retain a suppression record so the address is not inadvertently re-added to marketing email.
Unsubscribing from marketing email does not necessarily opt a subscriber out of SMS/MMS or telephone communications for which the subscriber separately enrolled. Subscribers may request broader preference changes through the contact method in Section 16.
6. Telephone Call Policy
When permissible by law and supported by the subscriber's channel-specific permission, Liliths may place occasional live, automated, artificial-voice, or prerecorded calls concerning news, promotions, products, events, surveys, personalized offers, and related updates.
Consent to receive automated or prerecorded marketing calls is not a condition of purchase. Call frequency may vary. A subscriber may revoke permission by clearly telling us during a call or by using the contact method in Section 16. Liliths will honor applicable do-not-call requirements and maintain internal do-not-contact records.
Telephone carriers and service providers may assist with call routing, delivery, analytics, recording notices where used and lawful, fraud prevention, and preference management. Calls may be delayed, blocked, or undelivered for reasons outside Liliths' control.
7. SMS/MMS Messaging Policy and Terms
The Liliths High Tide SMS/MMS sending program is not currently active. Liliths may retain separately recorded SMS/MMS consent for a possible future program. If the program is activated, these terms will apply only to people who separately provided valid consent to receive SMS/MMS communications.
Program description
Enrolled subscribers may receive occasional recurring automated SMS or MMS messages containing Liliths news, promotions, product announcements, event invitations, surveys, personalized offers, and related updates. Message frequency varies.
Charges and delivery
Message and data rates may apply. Subscribers are responsible for charges imposed by their wireless provider. Liliths, Mailchimp, participating carriers, and messaging providers do not guarantee message delivery and are not liable for delayed or undelivered messages to the extent permitted by law. Not all devices, carriers, or locations may be supported.
Opting out and help
For a two-way U.S. sending number, reply STOP to opt out. Other recognized opt-out keywords may include CANCEL, END, QUIT, UNSUBSCRIBE, OPTOUT, or REVOKE. A single nonmarketing confirmation message may be sent after an opt-out request. Reply HELP for help when that function is available, or use the contact method in Section 16. After an SMS/MMS opt-out, Liliths may retain the number on a suppression list to honor the request.
Consent and number ownership
Consent to receive automated marketing texts is not a condition of purchase. A subscriber represents that the subscriber is the current subscriber or customary user of the mobile number provided and will promptly notify Liliths if the number changes or is reassigned. SMS/MMS consent applies only to the program and sender identified when consent is obtained and may be withdrawn at any time.
Carrier disclosure
Wireless carriers are not responsible for delayed or undelivered messages. Carrier participation and program availability may change without notice.
8. Consent, Preferences and Withdrawal
Consent and preferences may be channel-specific. A subscriber may choose email without choosing SMS/MMS or automated or prerecorded calls, where those options are offered. Opting out of one channel does not automatically opt the subscriber out of every other channel unless the request clearly asks Liliths to stop all marketing communications or applicable law or provider rules require a broader opt-out.
Subscribers may withdraw consent by using the unsubscribe or STOP mechanism associated with a message, by making a clear request during a call, or through the contact method in Section 16. Liliths may send communications needed to confirm or process the request and may retain limited suppression and consent records after withdrawal.
Liliths may suspend or terminate a subscriber's participation in any channel if continued messaging would violate law, carrier requirements, service-provider rules, this Policy, or the security and integrity of the program.
10. Mailchimp and Other Service Providers
Liliths uses Mailchimp to host or support signup forms, maintain audience records, manage preferences, send email, and, if activated, support SMS/MMS messaging. Mailchimp may process subscriber information on Liliths' behalf and may use certain information as described in its own terms, privacy statement, and cookie statement.
The Liliths High Tide homepage currently includes a Mailchimp connected-site script. Depending on which Mailchimp features are enabled, Mailchimp connected-site technology may use cookies, pixels, scripts, local storage, or similar technologies to measure visits, recognize interactions, support signup features, attribute activity, or provide related Mailchimp functionality. The information processed and technologies used depend on the Mailchimp features selected by Liliths.
Cloudflare Turnstile
Liliths uses Cloudflare Turnstile on the contact form to help distinguish legitimate visitors from automated traffic and protect the website from spam, fraud, and abuse. Cloudflare may process limited device, browser, network, interaction, and security information necessary to provide this service. According to Cloudflare, Turnstile does not access, store, or transmit a visitor's form entries or other page inputs.
Those third-party documents govern the third party's own services and practices. They do not replace this Policy or eliminate Liliths' responsibility for its own website and communications practices.
12. Data Retention
Liliths retains information for as long as reasonably necessary to operate and secure the website, respond to inquiries, administer the communications list, fulfill the purposes described in this Policy, comply with legal and provider requirements, resolve disputes, protect the program, and enforce preferences. Retention periods may differ by record type and service-provider configuration.
When a subscriber opts out, Liliths may keep limited suppression records, consent history, opt-out records, and message history to demonstrate compliance and prevent unwanted contact.
Website usage, security, Mailchimp, Cloudflare, and Google Analytics information may be retained according to Liliths' settings and the applicable provider's practices. Information that is no longer reasonably necessary will be deleted, anonymized, aggregated, or otherwise handled in accordance with applicable requirements and technical limitations.
13. Data Security
Liliths uses reasonable administrative, technical, and organizational safeguards designed to protect information collected through the website, contact forms, and communications program. These may include limited access, service-provider controls, account security, and appropriate retention practices. No website, database, transmission method, or storage system can be guaranteed completely secure.
14. Visitor and Subscriber Choices and Privacy Requests
Subject to applicable law and appropriate identity verification, a website visitor or subscriber may ask Liliths to provide information about an applicable record, correct inaccurate information, delete information that Liliths is not required to retain, or update communications preferences.
Liliths may need enough information to locate and verify the request. We will not require more information than reasonably necessary and may deny or limit a request when permitted by law, including when retention is necessary to honor an opt-out, protect security, establish legal claims, comply with an obligation, or preserve information that cannot reasonably be associated with the requester.
15. Children's Privacy
The website and communications program are intended for a general audience and are not directed to children under 13. Liliths does not knowingly collect personal information online from a child under 13 without any notice and verifiable parental consent required by law. If Liliths learns that it collected such information without required permission, it will take reasonable steps to delete or otherwise address the information. A parent or guardian may contact Liliths using the method below.

17. Changes to This Policy
Liliths may update this Policy to reflect changes in the website, communications program, analytics, cookies, service providers, practices, or legal requirements. The current version will identify when it was last updated. If a change materially affects how previously collected information is used, Liliths will provide any notice or obtain any additional consent required by law.
18. Governing Terms
This Policy and the communications terms it contains are governed by applicable federal law and, to the extent not preempted, the laws of the State of Florida, without limiting any nonwaivable rights a visitor or subscriber may have. If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A waiver on one occasion is not a continuing waiver.
